**Terms of Use**
These terms and conditions apply when using the transportation reservation service "TabiBites" provided by Figurative Japan Corporation (hereinafter referred to as "the Company"). Please read these terms and conditions and agree to their contents before using the service.
**Application of Terms**
These terms and conditions establish the various conditions for users when receiving the services provided by the Company.
In addition to these terms, the Company may establish individual terms and guidelines related to the use of the service. In such cases, these individual terms and guidelines shall take precedence over these terms and conditions.
When a user utilizes the service, it is deemed that the user has agreed to these terms.
If the user is a minor, consent from a parent or legal guardian is required to use the service. The Company will consider that such consent has been obtained for the use of the service by a minor.
**User Registration**
Users can register by providing necessary information in the manner specified by the Company.
Users must provide accurate and up-to-date information to the Company.
If there are changes to the registered information, users must promptly notify the Company of the changes.
The Company is not responsible for any damage or disadvantage suffered by the user due to inaccurate or false information, or due to failure to notify the Company of changes.
**Management of ID and Password**
When a user completes registration, the Company will issue an ID and password.
Users must strictly manage and store their ID and password, and must not lend, transfer, sell, or otherwise allow a third party to use them. The Company is not responsible for any damage or disadvantage suffered by the user due to inadequate management of the ID or password.
If a user loses or forgets their ID or password, or if it is discovered that these have been used by a third party, the user must immediately notify the Company.
The Company will consider all use of the service with the issued ID and password as the user's own actions, regardless of whether it is legitimate use or not, and the user will bear all responsibility for the results of such actions.
Users can terminate their service contract at any time following the Company's prescribed procedures. However, if the user has unfulfilled obligations under the contract or other reasonable reasons, the Company may not acknowledge the termination of the contract. Once the service contract is terminated, registration information and other usage information of the service will become inaccessible.
**Purchasing Products and Services**
Users may purchase or use products, digital content, or services (hereinafter referred to as "Products, etc.") provided by vendors (those who have separately concluded a contract with the Company, hereinafter referred to as the same) through the service.
When applying to purchase or use Products, etc., a contract for the purchase or use of the Products, etc., is established between the user and the vendor when the user confirms the entered items and application content and clicks the button to finalize the application.
The Company is not responsible for the content of the Products, etc., and other related matters, which shall be resolved between the vendor and the user. However, the Company may enter into discussions based on its judgment.
**Payment Methods**
Users must pay the price of the Products, etc., displayed during the purchase process.
Payment methods for the Products, etc., will be those guided during the purchase process or otherwise approved by the Company.
If payment is made by credit card, the user must comply with the terms separately contracted with the credit card company. If any dispute arises between the user and the credit card company in connection with the use of the credit card, the user will resolve such disputes at their own responsibility and expense.
**Withdrawal or Cancellation of Contract after Purchase Procedure**
Except with the agreement of the vendor and the user, it is not possible to withdraw or cancel the application for the purchase or use of Products, etc., after the purchase procedure.
However, cancellation is accepted if the cancellation fee is paid according to the cancellation policy.
**Disclaimer regarding Products, etc.**
Products, etc., sold through the service are sold and provided by the vendors, and the Company is not responsible for the Products, etc.
The Company does not guarantee the legality, usefulness, completeness, accuracy, currency, reliability, or suitability for a specific purpose of the information displayed on the website of the service, the photos and comments about the Products, etc., posted by users, or comments posted on Twitter, Instagram, or other SNS services.
**Intellectual Property Rights and Content**
All rights, including copyright, related to the materials constituting the service, belong to the Company or third parties having such rights. Users shall not acquire any rights to all materials of the service and shall not infringe on the rights related to the materials without the permission of the right holders. The license to use the service under these terms does not imply a license to use the rights of the Company or third parties related to the service.
**User Posts**
Information such as writings, reviews, comments, etc., and images, illustrations, and other content (hereinafter referred to as "User Posted Information") posted, uploaded, or made viewable by users within the service are accessible and viewable by an unspecified number of users of the service. Users must understand this and use the service accordingly. Users bear all responsibility for the User Posted Information they post.
Users may not post the following information:
- Information that is not true.
- Expressions or images that are obscene, including nudity.
- Information that damages the honor or credit of others.
- Information that infringes on the privacy rights, portrait rights, copyright, or other rights of third parties.
- Information containing computer viruses.
- Links or URLs to websites other than those approved by the Company.
- Other information deemed inappropriate by the Company.
Users permit the Company to use User Posted Information free of charge. In granting this permission, users represent and warrant the following:
- They have legitimate rights such as copyright, neighboring rights, portrait rights, or have received all necessary permissions from the legitimate rights holders for the use of User Posted Information in the service.
- The posting of User Posted Information and its use by the Company do not infringe on the copyright, neighboring rights, portrait rights, or any other rights of third parties.
The Company can monitor the content of User Posted Information to ensure the safe use of the service by users.
The Company may delete User Posted Information without prior notice to the user and restrict the user's posting if the User Posted Information violates these terms or if the following conditions apply:
- A certain period of time has passed since the post.
- Necessary for maintenance and management of the service.
- The capacity of User Posted Information exceeds or may exceed the prescribed capacity of the Company's equipment.
The Company is not obligated to respond to users about the reasons for deletion and posting restrictions and is not responsible for any damage or disadvantage to users due to deletion and restrictions. Also, the Company is not obligated to delete User Posted Information.
Users agree in advance to the monitoring, deletion, and restriction of posting of User Posted Information under this article.
**Notices to Users**
The Company may periodically or irregularly send email newsletters to users to provide the latest information and recommendations about the services offered by the Company.
**Changes, Additions, and Suspension of Service**
The Company may change, add, or suspend all or part of the service without prior notice to users, and users agree to this in advance.
**Personal Information**
The Company will handle personal information obtained through the use of the service by users appropriately in accordance with the Company's privacy policy.
**Prohibited Actions**
Users may not engage in the following actions:
- Actions that hinder or may hinder the operation of the service.
- False transportation requests.
- Actions that interfere with other users' use of the service.
- Requests for transportation for purposes of carrying an amount or size of luggage beyond what is normally anticipated in passenger transport (such as a large amount of moving luggage or large industrial materials).
- Exploiting bugs or malfunctions of the site.
- Infringing on copyright or other rights related to the service.
- Allowing, lending, transferring, selling, pawning, or otherwise disposing of the service account to a third party.
- Infringing on the rights or interests of the Company, other users, or third parties (including but not limited to rights of honor, privacy, and copyright).
- Actions contrary to public order and morals or other laws and regulations, or actions that may violate them.
- Actions that violate these terms.
- Other actions deemed inappropriate by the Company considering the purpose of the service.
If the Company determines that a user has engaged in the actions specified in the preceding paragraph, the Company may suspend all or part of the service or take other measures deemed necessary and appropriate by the Company without prior notice to the user. The Company is not responsible for any damage or disadvantage suffered by the user as a result of these measures.
**Exclusion of Anti-Social Forces**
Users assure the Company of the following:
- They are not anti-social forces such as gangsters, companies related to gangsters, sokaiya, or similar persons or members thereof (collectively referred to as "anti-social forces").
- Their officers (employees who execute business, directors, executive officers, or similar persons) are not anti-social forces.
- They do not use their name to conclude contracts with anti-social forces.
- They or third parties do not engage in the following actions:
- Threatening behavior or violence against the other party.
- Demands beyond legal responsibility.
- Disrupting the business of the other party or damaging their credit by deceit or force.
**Disclaimer**
In the event of natural disasters, war, terrorist acts, riots, labor disputes, infectious diseases, enactment, amendment or abolition of laws, intervention by government agencies, or other force majeure, causing the whole or part of this service to be suspended, interrupted, or delayed, the Company shall not be liable for any damage or disadvantage incurred by the user.
The user understands that the whole or part of this service may be suspended, interrupted, or delayed due to communication line or computer failures, system maintenance, or other reasons, and the Company shall not be liable for any damage or disadvantage caused to the user by these circumstances. Furthermore, the Company shall not be liable for any damage or disadvantage caused to the user due to their usage environment.
The Company makes no explicit or implicit guarantees regarding the following matters:
The usefulness, completeness, accuracy, timeliness, reliability, and suitability for a specific purpose of the content of this service and the information provided through this service.
That the information provided by the service does not infringe the rights of third parties.
The continued existence of the service in the future.
Regardless of the reason, the Company shall not be obligated to restore data or other information that is lost, damaged, or altered, and shall not be liable for any damage or loss incurred by the customer or third parties due to such loss, damage, or alteration.
In cases where the Company is liable to the user in connection with the use of this service, the Company shall not be liable for compensation beyond the value of the relevant goods or services, and shall not be liable for incidental, indirect, special, future damages, or lost profits.
Notwithstanding other provisions of this article, if the contract between the Company and the user regarding this service becomes a consumer contract as defined by the Consumer Contract Act, and if it is due to the intentional or gross negligence of the Company, the exemption provisions shall not apply.
**Confidentiality**
Users shall not disclose or leak any information disclosed by the Company or obtained in the course of using this service to third parties, and shall not use it for purposes other than using this service.
**Notices from the Company**
When the Company communicates with the user, it will do so by sending an email to the email address registered by the user, posting on the website related to this service, or by any other method the Company deems appropriate.
If the Company sends a notice to the email address mentioned in the previous paragraph, the notice is considered to have reached the user when it is recorded on the mail server of that email address.
If there is a change in the email address in paragraph 1, the user must promptly notify the Company. Notices sent by the Company to the email address before it receives notice of the change are deemed to have reached the user at the time of dispatch.
The Company bears no responsibility for any damage or disadvantage incurred by the user due to their failure to provide notice as specified in the previous paragraph.
**Disputes with Third Parties**
For disputes arising between the user and third parties in relation to this service, the user shall resolve such disputes at their own expense and responsibility, and the Company shall bear no liability whatsoever.
In connection with the preceding paragraph, if the Company incurs any damage (including attorney's fees), the user shall compensate the Company for such damages.
**Prohibition of Transfer of Rights and Obligations**
The user may not transfer, convey, create a security interest in, or otherwise dispose of all or part of their rights and obligations under the contract based on these terms and conditions to a third party without the prior written consent of the Company.
**Severability**
If any provision of these terms and conditions is found to be in violation of the law applicable to the contract with the user based on these terms and conditions and is invalid, such provision shall not apply to the contract with that user to the extent of the violation. This does not affect the validity of the other provisions of these terms and conditions.
**Amendments to These Terms and Conditions**
The Company may amend these terms and conditions as necessary, based on Article 548-4 of the Civil Code (Amendment of Standard Terms and Conditions). When amending these terms and conditions, the Company will inform users of the following matters by email or other methods before the effective date:
The fact that these terms and conditions are being amended
The content of the amended terms and conditions
The effective date
**Governing Law and Jurisdiction**
These terms and conditions shall be interpreted in accordance with Japanese law.
The Company and the user agree in advance that the Nagoya District Court shall be the exclusive jurisdictional court of the first instance for the resolution of disputes arising between the Company and the user in relation to this service.
*In case of discrepancies between the Japanese version and versions in other languages, the Japanese version will take precedence.
